Employees who have been involved in a accident must submit to a Drug test and Breath Alcohol Test (BAT} as soon as possible. This must be done from the time of the reportable accident. A Breath Alcohol Test (BAT) must be done within 8 hours and a urine Drug Screen (UDS) has to be done within 32 hours after the accident as defined by DOT Guidelines.
The employee should refrain from alcohol within the 8 hour time period due to testing. Now an employer has the right to obtain records from the employee’s medical records, and the results of any test obtained during the treatment. The refusal of the employee to allow the collection of these specimens or attempt to block the release of said specimen will result in the immediate medical disqualification of the employee Which in turn is a failed drug test.
